How to Buy Property in Montenegro — Step-by-Step Guide 2026

A complete walkthrough of the Montenegro property purchase process for British buyers — from the initial search through legal due diligence, notarial signing, title registration and a full breakdown of all costs and taxes involved.

Step 1: Property Search & Offer

Identify the property and agree on the purchase price with the seller. A verbal offer is not legally binding in Montenegro — the purchase process only begins formally at Step 2.

Step 2: Preliminary Purchase Agreement

Both parties sign a Preliminary Purchase Agreement (Predugovor o Kupoprodaji) and the buyer pays a deposit, typically 10% of the purchase price. This agreement binds both parties — if the seller withdraws they must return double the deposit; if the buyer withdraws they forfeit the deposit.

Step 3: Legal Due Diligence

An independent Montenegrin solicitor conducts title searches at the Real Estate Cadastre to confirm clear ownership, no mortgages, no disputes, and correct planning status. This stage typically takes 2–4 weeks.

Step 4: Notarial Sale Contract

The final Sale and Purchase Agreement (Ugovor o Kupoprodaji) is executed before a licensed Montenegrin notary. Both parties or their authorised representatives must be present. The buyer pays the remaining balance at this stage.

Step 5: Title Registration

The notary files the transfer with the Real Estate Cadastre. Title registration typically completes within 30–60 days of submission.
